Playbook UX LLC (together with its associated companies) (“us”, “we”, or “our”) respects your privacy and promises to use appropriate measures to protect any personal data we collect about you or that you provide to us (“your information”). We collect, use and maintain personal information in compliance with:

  • The UK Data Protection Act (2018)
  • The Privacy and Electronic Communications (EC Directive) Regulations (2003)
  • The General Data Protection Regulation (Regulation (EU) 2016)
  • The California Consumer Protection Act (CCPA)
  • The California Privacy Rights Act (CPRA)
  • All other applicable regulations

This Privacy Notice helps explain how we collect, use and disclose information (“Personal data”) that we collect from you and the choices we offer, including how to access, update or delete your information. By providing information to us, using our products or services, accessing our websites, or otherwise interacting with us, you agree to and are consenting to be bound by the terms and conditions of this Privacy Notice. If you do not agree with our policies and practices, please do not use our services. 

 

This Privacy Notice (together with our Terms and Conditions of use of our websites https://www.playbookux.com, https://app.playbookux.com, https://tester.playbookux.com/sign-in (hereinafter referred to as “Service”) and any other documents referred to on it) sets out the basis on which your Unless otherwise defined in this Privacy Notice, the capitalized terms used in this Privacy Notice have the same meanings ascribed to them in our Terms and Conditions.

 

 

COLLECTION OF YOUR INFORMATION BY US

We may collect several different types of information from you through our websites, products, and services, online or offline interactions, and other means offered and controlled by us  for various purposes to provide and improve our Service to you. The information collected from you may include Personal Information. “Personal Information” or “Personal Data” in information relating to an individual, for example: a first and last name, a home or other physical address, an email address or other contact information whether at work or at home. PlaybookUX may collect and process the following Personal Information on you: 

  • Contact and Identity Data, such as your name, postal address, email address, telephone number, state, province, country, region, ZIP Code
  • Cookies, Analytics, and Third-Party Technologies. We collect information through the use of “cookies,” which are small text files that web servers place on your device designed to store basic information and to help websites and apps recognize your browser and data analytics tools like Facebook and Google Adwords.
  • Device Information, Technical/Usage Data, we may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device. This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. When you access Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
  • Marketing and Communication Data, including your preferences in receiving marketing from us and your communication preferences
  • Profile Data, including usernames, passwords and feedback data
  • Other Data, which may include the following information: sex, age, date of birth, place of birth, passport details, citizenship, registration at place of residence and actual address, telephone number (work, mobile), details of documents on education, qualification, professional training, employment agreements, non-disclosure agreements, information on bonuses and compensation, information on marital status, family members, social security (or other taxpayer identification) number, office location and other data. 
  • Support Request Data, such as information we may require from you when you report a problem with our service, such as the subject of your request for support.

HOW WE MAY COLLECT YOUR PERSONAL DATA

Playbook UX collects Personal Data from you directly, through automated means and from third parties, as described below: 

  • Directly From You. We collect Personal Data when you voluntarily provide it to us (including to our service providers, partners or other parties who collect it on our behalf). For example, we collect Personal Data when you evaluate, order, purchase, use or request information about Playbook UX products and services, request or subscribe to marketing communications, complete surveys, provide such data in product feedback or sign up for a Playbook UX event. We may also collect Personal Data from you when you attend one of our events, during phone calls with sales representatives or when you contact customer support. 
  • Automatically. We may use technology that is integrated into our online assets to provide us with automated data collection when you use, access, or interact with our online assets (e.g. cookies, web beacons). 
  • Third Parties. We may also acquire data from other sources, including our affiliates, partners, service providers, or others that we use to make our information better or more useful. This information may include any of the information we collect from you directly, or that is collected automatically via our online assets. 

 

COOKIES

We use cookies and similar tracking technologies to track the activity on our Service, and we hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used, such as beacons, tags, and scripts, to collect and track information and to improve and analyze our Service. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.

Examples of Cookies and the purposes for which we use them:

  • Advertising Cookies: Advertising Cookies are used to serve you with advertisements that may be relevant to you and your interests.
  • Preference Cookies: We use Preference Cookies to remember your preferences and various settings.
  • Security Cookies: We use Security Cookies for security purposes
  • Session Cookies: We use Session Cookies to operate our Service.

HOW WE MAY USE YOUR DATA

Playbook UX LLC uses the collected data for various purposes:

  • to provide and maintain our Service;
  • to notify you about changes to our Service; 
  • to allow you to participate in interactive features of our Service when you choose to do so;
  • to provide customer support; 
  • to gather analysis or valuable information so that we can improve our Service; 
  • to monitor the usage of our Service;
  • to detect, prevent and address technical issues;
  • to fulfill any other purpose for which you provide your data;
  • to fulfill a legal obligation and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;
  • to provide you with notices about your account and/or subscription, including expiration and renewal notices, email-instructions, etc.;
  • to provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information
  • in any other way we may describe when you provide the information;
  • for any other purpose with your consent. 

 

INTERNATIONAL TRANSFERS OF PERSONAL DATA

To facilitate our global operations, your information may be transferred to and accessed from jurisdictions other than your own to process and store data in accordance with this Privacy Notice and to provide you with products and services. Playbook UX may store information in the United States and other locations worldwide where we or our service providers maintain facilities. Where applicable, Playbook UX relies upon an adequate mechanism for the international transfer of personal information. 

Playbook UX places substantial importance on protecting the confidentiality of personal information and seeks the cooperation of its suppliers in furthering this goal. As such, we will only transfer personal information to suppliers where such suppliers have provided assurances that they will provide at least the same level of privacy protection as is required by this Notice. Where we have knowledge that a supplier is using or sharing personal information in a way that is contrary to this Privacy Notice, we will take reasonable steps to prevent or stop such processing. 

 

LEGAL BASIS FOR PROCESSING PERSONAL INFORMATION (EEA VISITORS ONLY)

If you are a visitor from the European Economic Area and the United Kingdom, Playbook UX’s legal basis for collecting and using the Personal Information collected will depend on the Personal Information concerned and the specific context in which we collect it. In most circumstances, we collect Personal Information: (i) where it is needed for the performance of a contract, (ii) where the processing of the Personal Information is in our legitimate interests and not overridden by your rights, or (iii) where you provide your consent. In other instances, your Personal Information may be collected in order for us to: (iv) comply with a legal obligation, (v) to perform a task for the public interest or (vi) for the protection of your or another’s vital interests. 

 

If we collect and use your Personal Information in reliance on our legitimate interests or those of any third party, we will make clear to you at the relevant time through this Notice or otherwise what those legitimate interests are. Legitimate interests typically involve our normal day-to-day operations, such as the ability to operate our platform and communicate with you as necessary to provide our Services, responding to your inquiries, or marketing. We may transfer Personal Information to companies that help us provide our Services. Transfers to subsequent third parties are covered by the service agreements with our customers.

SECURITY

We make best efforts to hold all Personal Data securely in accordance with our internal security procedures and applicable law. We update and test our security on an ongoing basis. While we will do our best to protect your Personal Data, we cannot guarantee the security of your data transmitted to our site through the internet; any such transmission is at your own risk. Once we have received your information, we will maintain appropriate administrative, physical, technical and organizational measures to protect your Personal Data accessed or processed by us against unauthorized or unlawful processing, accidental loss, destruction, damage or disclosure. 

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

DISCLOSURES

We do not sell, lease, rent, or give away your Personal Information. If we share your information, we require those that we share it with to comply with appropriate security standards and privacy and confidentiality requirements. We may disclose personal information that we collect, or you provide as follows:  

  • Affiliates. We may disclose your information to our affiliates subject to these obligations
  • Consent. We may disclose your information upon your consent.
  • Compliance and Safety. We may disclose your information as we believe to be necessary or appropriate: (i) under applicable laws; (ii) to comply with legal processes; © to respond to requests from public and governmental authorities, including to meet national security or law enforcement requirements; (d) to enforce our terms and conditions; (e) to protect our operations; (f) to protect our rights, privacy, safety or property, and/or those of our affiliates, you, or others; and (g) to allow us to pursue available remedies or limit damages that we may sustain. 
  • Corporate Transaction. We may disclose your information to a buyer or other successor in the event of a merger, sale, divestiture, restructuring, reorganization, dissolution or other transfer of some or all of Playbook UX’s assets. 
  • De-Identification. We may disclose your information in a de-identified form, which cannot reasonably be used to identify you. 
  • Service Providers. We may disclose your information to our service providers, contractors, vendors, subprocessors and other third parties we use to support our business. 

You agree not to send or disclose to us any Sensitive Personal Information. “Sensitive Personal Information,” as used in this Notice means special categories of personal data that are generally considered as raising greater privacy risks to data subjects if disclosed. If for some reason, Sensitive Personal Information is collected by us, we will not disclose such information to a non-agent third party or use such information for a purpose other than the purpose for which it was originally collected or subsequently authorized by you unless we have received your affirmative and explicit consent (unless you have “opted in”). 

DATA RETENTION

We will retain your Personal Data only for as long as is reasonably necessary for the purposes set out in this Privacy Notice. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

 

YOUR RIGHTS

Depending on the applicable local data protection laws, you may have certain rights relating to your Personal Data. These rights may include:

  • Opt-out. You may contact us at any time to opt out of: (i) direct marketing communications; or (ii) any new processing of your Personal Information that we may carry out beyond the original purpose. If you choose not to provide certain information depending on the nature of your relationship with us, you may be unable to engage in certain activities or use certain products and Services. Opt-out processes may take some time to complete, but we will work to action your request as quickly as possible. In certain circumstances, you may still continue to receive administrative messages or other required communications that are a part of the Services unless you stop using or cancel the Service in accordance with its terms. 
  • Objection. You may contact us to object to the processing of your Personal Data by us. 
  • Access. You may request a copy of the categories or specific pieces of Personal Data that we have collected about you and to review the information that you have supplied to us; 
  • Update/Correction. You may request that we correct any errors, outdated information, or omissions from your information that you have supplied to us;
  • Erasure/Deletion. You may request that we delete the Personal Data that we have collected about you.
  • Restriction. You may request the restriction of processing activities in connection with your Personal Data.

When contacting us, please specify what Personal Information the request is concerning and which of the above rights you would like to exercise. For your protection, we will only respond to verifiable requests. We will use commercially reasonable efforts to comply with your request. In certain circumstances, we may not be able to fulfill your request if we believe such request would violate any law or legal requirement or otherwise cause the information to be incorrect. Additionally, we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to your request. You have the right not to be discriminated against if you exercise any of your rights under applicable data protection laws. 

INFORMATION ABOUT CHILDREN 

Our websites are not intended for or targeted at children under the age of 18, and we do not knowingly or intentionally collect information about children under 18. If you believe that we have collected information about a child under the age of 18 without the consent of their guardian, please contact us at hello@playbookux.com so that we may delete the information. 

 

RETENTION OF YOUR INFORMATION 

We retain your information as long as we consider it potentially useful in contacting you, and we then securely delete the information. We will delete this information from the servers at an earlier date if you so request by contacting us at hello@playbookux.com

 

CHANGES TO THIS PRIVACY POLICY 

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and/or by email. Changes to this Privacy Policy are effective when they are posted on this page. You are advised to review this Privacy Policy periodically for any changes. and your continued use of the websites and/or continued provision of your information to us will be subject to the terms of the then-current Privacy Policy.
